  • 114m claim over Haulbowline clean-up

    A company is claiming €114m in damages from three other firms over the clean-up of the former Irish Steel plant at Haulbowline Island.

    The proceedings are being brought in the Commercial Court by Louis J O'Regan Ltd against the three other firms, CTO Greenclean Environmental Solutions Ltd, Hammond Lane Metal Company Ltd and Eastwood Ltd, over alleged breaches of agreements to clear contaminated materials from the site.

    The case was admitted to the Commercial Court list this morning.

    One of the companies, Hammond Lane Metal Company Ltd, claims there is no basis for the claim against it.

    In separate proceedings, Hammond Lane is suing the State over its alleged failure to pay sums of more than €8m arising from the clean-up.

    It will apply to have that case transferred next week to the Commercial Court.

      AN ENGLISH company is claiming €114 million damages against three firms over alleged breaches of agreements to clear contaminated materials from the former Irish Steel plant site at Haulbowline island in Co Cork.

      In separate proceedings, the State is being sued by Hammond Lane over its alleged failure to pay sums of more than €8 million arising from the clean-up.

      At the High Court in Dublin yesterday, Mr Justice Peter Kelly entered the proceedings by Louis J O’Regan Ltd, with an address at Staffordshire, England, into the Commercial Court. He was told a further application will be made next week to transfer the action against the State to the court.

      O’Regan Ltd has sued CTO Greenclean Environmental Solutions Ltd, with an address at Sarsfield Road, Wilton, Co Cork; Hammond Lane Metal Company Ltd, Pigeon House Road, Dublin; and Eastwood Ltd, Herbert Street, Dublin, for alleged breaches of a purported partnership agreement and written contracts of August 2007 between the sides for the clearance of the contaminated materials from the Haulbowline site.

      O’Regan Ltd has claimed in correspondence with solicitors for Hammond Lane the State failed to inform it of the nature and quality of toxic waste on the Haulbowline site and/or the hazardous way in which that waste was stored.

      The application to transfer the case to the Commercial Court was brought by Hammond Lane, which argues there is no basis for the claim against it.

      Prior to the O’Regan action, Hammond Lane initiated separate proceedings against the Minister for Environment, Heritage and Local Government over an alleged agreement under which the Minister appointed the company for the surface clean-up of the demolition and waste tip areas at the Haulbowline site, formerly owned by Irish Ispat Ltd.

      Hammond Lane claims the Minister had in May 2008 ordered it to cease all works at the site and had served a notice of termination on the company days later.

      • naval service are now in charge of security from the end of the bridge does this mean that the dept of defence now own the whole island

              Perhaps the question should have been 'who's decision was it to put a steel plant there in the first place', in what is a built up area.

              • Irish Steel was set up on Haulbowline in 1938. Established by a private consortium, it was taken over by the government after World War II and was the only steel processing plant in Ireland.
                They went into liquidation in 1947, when the State bought it from the liquidator because of the strategic importance of steel and the need to preserve employment in heavy industry.

                  i think ye are taking me up wrong .. the haulboline duties now man the barrier at the end of the bridge is this not wrong as they are now being put in a position of security for the whole island.ie old demolished site etc which is not dept of defence property and why was the civilian security stopped . obviously some senior officer took on this area..

                    Any organisation that claims the defence of the state as its primary reason for existing will hardly have difficulty with maintaining security on a small island where only it resides??

                      manning the primary enterance hardly equates to a cordon of steel around the place.

                      If anything the NS is stopping the general public from popping in to have a look at our own 'Three mile island.'

                      The Steel and The NS side of theings while based on the same piece of land were always two different entities, having the NS now provide acess control to the whole site is just providing said same control on the cheap.

                      If it was up to me..move the NS from the location and cordon off the whole place.

                        at last someone who sees some sense on the point i was making and has done duties of a similar nature... the naval service should not be performing military duties in an area that is not a military checkpoint

                        • I noticed yesterday a large body of well dressed visitors to the East tip on the island, all decked out in the best new flourescent vests.
                          I wonder is something afoot, or just another "fact finding mission" by Cork CoCo?
