DFRs and indeed, the Defence Act only apply to people while they are subject to Military Law. Reservists are only subject to Military Law under certain circumstances. However, this will be changing soon, and Reservists will become subject to military law 24/7.

The only defence amendments currently before the Oireachtas is Billy Timmons (Fine Gael) Bill about the PDF training overseas. Any idea what the story is?

i'd like to know where you got the information from kermit...and if, in theory, a serving member of the RDF was to get a bit drunk and start a fight, and get arrested, could he be charged under military law??

as far i as i know we could always be charged while in uniform, what kermit is suggesting,in my opinion, is we are under military law all the time

Is that for any/every incident when the GS are involved?

It's not before the Dail yet. It will be proposed by the Defence Forces / Dept of Defence in the next session.

Is this even the case for PDF at the moment i.e. they are subject to mil law 24/7 even when e.g. they are on holidays and have an incident with the Gardai?

Or will status change when the ammendment is proposed?

Application of Act to persons subject to military law.
3.—The application of this Act to a person subject to military law shall not be affected by reason of the fact that such person is for the time being outside the State or on board a ship or aircraft.


119.—Each of the persons mentioned in this section shall, for the purposes of this Act, be a person subject to military law as a man—

( a ) a man of the Permanent Defence Force at all times,

( b ) a reservist when—

(i) he is called out on permanent service or in aid of the civil power, or
(ii) he is called out for training, exercise or other duty under this Act, or
(iii) he is voluntarily attending training, or
(iv) he is undergoing treatment in a military hospital, or
(v) he is employed on military service under the orders of an officer, who is himself subject to military law, or
(vi) he is in uniform,
