Legally there is a big difference traditionally armed aircraft and one which has sigint and comint gear.

So the controller could allow the Bear to cross Irish sovereign airspace and not allow the Typhoons to follow.
If that was the case the RAF would be having kittens while the Russian play.

Ireland is not a member of the Military Open Skies Treaty, and if a Aircraft Suddenly appeared on secondary radar requesting clearance across Ireland (Sovereign Airspace) I would be very surprised if ATC just said sure why not, unless it was for an Emergency Landing at a well known west coast airport (Which some people suggest might be a suitable location for AC QRA).

It does though raise a number of questions about the legal standing of the so called "secret" deal between RAF and the Irish Government, if god forbid the worst case scenario happened that required a shoot down over Ireland.

Any Bear type aircraft will have it's own defensive cannons loaded before take off,plus you have no idea what kind of ordnance it may be carrying in it's bomb bay, so you have to assume it's armed, in the same way that you assume a Naval warship is armed (but not combat ready) when it arrives on a peaceful visit. If a Bear declared an emergency in flight, as it passed down our West coast, we would be duty bound to render assistance, regardless of it's military origin.

Yes international law doesn't really have much to say on espionage.

So the controller could allow the Bear to cross Irish sovereign airspace and not allow the Typhoons to follow.

The controller could allow it if there had been a DAC previously filed by the Russians to the Irish Government if it was a military aircraft and the command pilot gave the controller the DCN to validate it.

If that was the case the RAF would be having kittens while the Russian play.

I would assume they would have a DCN code as well to give the controller after all it would be all part of the agreement whereby the RAF are policing Irish skies for Ireland's benefit.

Indonesia has decided it wants to buy all Austria's Typhoons, only in service since 2002 (with a huge cloud over the purchase) and a decision made to ground them from this year made in 2017.
This also removed the political issues that would have arisen had Indonesia gone ahead with its intended purchase of SU 35, from Russia.

Next question.. what will Austria replace them with? They were one of the last operational users of the Saab Draken.
