        We have had at least 2 pages and 30 odd comments on Smiths bail applications, in the last 3 years there has been around 43 Sinn Fein supporters arrested for membership of terrorist organisation, most of those got bail.

        Yet there is practically no mention of it on here.

        I thought we were against all terrorism.

        My prediction, Smith will be either acquitted or found not guilty of the charges, unless one of you upstanding warriors have her isis membership card or a smoking gun.

            I’d reckon so, sure aren’t they both sides of the same coin, ira burned people alive, raped, sold drugs , robbed and control Sinn Fein, isis pretty much does the same in a warmer climate.

                I think there are a few issues here, Hedgie.

                1. If the outrage bus was to set out of the garage every time a Shinner was caught, it would never be in the garage. The IRA in all it’s guises are know scumbags (and indeed the same argument might be put forward for the organised crime and burglary gangs that get bail).

                2. I don’t know how many of the Irish Freedom Fighters / criminals are ex-members if the PDF and (allegedly) used that training to train others.

                3. Although the IRA / Sinn Fein / UVF /UDA whoever are murdering scumbags, ISIS did take it to a new level, both in terms of quantity and quality (for want of a better description). That does need acknowledgment.

                She might get off with it due to an inability for the Irish legal system to present a case because of logistical problems. The higher burden of proof of “beyond reasonable doubt” is a high bar. “The balance of probabilities” would be much different.

                Whether the publicity and discussion she has engendered is warranted or not is open to discussion. Personally, I think it is.

                  The recent case law from the SCC is worrying with regard to evidence that was only previously disclosed to the judge now having to be disclosed to the defence

                    Am I right in thinking that IRA membership could be “proved” if a Garda Superintendent swore that he had reasonable grounds to believe someone was an IRA member?

                      Not sure whether super or chief super but yes. It was accepted in law that their evidence was based on their access to a range of confidential sources or observations.
                      This and the wall of silence the provos gave in interview was enough legally for the judge to draw inference.
                      For now, everything hangs on implementation of the CoDF report.

                        The evidence was provided to the judges and they then judged it on its merits (defence didn’t get to see it)

                                Probably difficult to find friends or family willing to provide any support to her, now that her child is in their care, away from her influence.
                                Not too many from the islamic community would be keen to throw in with her either.
